("Hyperfair" or "us") is committed to protecting your privacy and ensuring you have a positive experience on our website and in using our products and services (collectively, "Products"). This policy outlines our handling practices and how we collect and use the Personal Data you provide during your online and offline interactions with us. As used in this Privacy Policy, “Personal Data” means any information that can be used to individually identify a person, and may include, but is not limited to, name, email address, postal or other physical address, credit or debit card number, title, and other personally identifiable information.

If you reside in the European Union (“EU”), United Kingdom, Lichtenstein, Norway, Iceland or Switzerland, you may have additional rights with respect to your Personal Data, as further outlined below. Hyperfair, Inc. will be the controller of your Personal Data that is provided, collected and/or processed pursuant to this Privacy Policy, except where otherwise expressly stated. Hyperfair, Inc. protects the privacy of all of its customers, visitors, users, and others (collectively "Users" or individually a "User") who visit or use www.hyperfair.com (the "Hyperfair Site"). Hyperfair employs adequate security measures consistent with standard industry practice, for information collected through the Hyperfair Site. We have adequate security measures in place in our physical facilities to protect against the loss, misuse, or alteration of the information we collect on our website. We also use internal protections to limit access to users’ personal information to only those employees who need the information to perform a specific job. This Privacy Notice details important information regarding the use and disclosure of User information collected on the Hyperfair Site. Hyperfair provides this Privacy Notice to help you make an informed decision about whether to use or continue using the Hyperfair Site. How Hyperfair Collects Information

User Provided Information: You provide certain personally identifiable information (such as your name and email address) to Hyperfair when choosing to participate in various activities on the Hyperfair Site such as uploading content, posting content or subscribing to newsletters or other mailing lists. Cookies Information: When you visit the Hyperfair Site, we may send one or more cookies - a small text file containing a string of alphanumeric characters - to your computer that uniquely identifies your browser. Hyperfair uses both session cookies and persistent cookies. A persistent cookie remains after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the site. Persistent cookies can be removed by following your web browser help file directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Hyperfair Site may not function properly if the ability to accept cookies is disabled. Log File Information: When you use the Hyperfair Site, our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser. Clear GIFs Information: When you use the Hyperfair Site, we may employ “clear GIFs” (a.k.a. Web Beacons) which are used to track the online usage patterns of our Users anonymously (i.e., in a non-personally-identifiable manner). In addition, we may also use clear GIFs in HTML-based emails sent to our users to track which emails are opened by recipients.

How Hyperfair Uses Information

If you submit personally identifiable information to us through the Hyperfair Site, then we use your personal information to operate, maintain, and provide to you the features and functionality of the Hyperfair Site. Any personal information or video content that you voluntarily disclose online becomes publicly available and can be collected and used by others. Any videos that you submit to the Hyperfair Site may be redistributed through the internet and other media channels, and may be viewed by the general public. We do not use your email address or other personally identifiable information to send commercial or marketing messages without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. We may, however, use your email address with your consent to provide news, information and services we believe you may be interested in, as well as for administrative purposes (such as notifying you of major Hyperfair Site changes or for customer service purposes). We use both your personally identifiable information and certain non-personally-identifiable information (such as anonymous User usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the Hyperfair Site and to create new features, promotions, functionality, and services by storing, tracking, and analyzing User preferences and trends. If you choose to use our referral service to tell a friend about our products, you represent that you have their consent to provide us your friend’s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the website. Unless we are authorized by your friend, we will only use your friend’s name and email address for the purposes of sending this one-time email and maintaining an activity log of our referral program.

You can choose whether to provide Personal Data to Hyperfair, but note that you may be unable to access certain options, offers, and services if they require Personal Data that you have not provided. Data Retention

As a general rule, we retain your personal information for as long as necessary to fulfill the purposes for which it was collected or as necessary to comply with our legal obligations, resolve disputes, maintain appropriate business records, and enforce our agreements. In general, for example, we will retain relevant contact information of clients, prospective clients and Site visitors for three years from the date of our last interaction with you and in compliance with our obligations under applicable laws. Our clients instruct us on how long to retain Client Data, which we handle as a data processor. We may retain personal information for longer where required by our regulatory obligations, professional indemnity obligations, or where we believe necessary to establish, defend, or protect our legal rights and interests or those of others.

Passive Collection

Hyperfair and our third party service providers automatically collect some information about you when you use our Products, using methods such as cookies and tracking technologies (further described below). Information automatically collected includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data to analyze trends in the aggregate and administer the website and/or Products.

In addition, when you use some of our Products, network information is transmitted back to us such as Product usage information. This information is transmitted back to us so we can determine how users are interacting with our Products, to assist us with improving our Products, and to correct any problems that may occur.

Cookies and Tracking Technologies

Hyperfair and our partners use cookies or similar technologies to analyze trends, administer the website, track users’ movements around the website, and gather information about our user base, such as location information based on IP addresses. Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. Our Products do not support Do Not Track requests at this time, which means that we collect information about your online activity both while you are using the Products and after you leave our properties.

Mobile Application

When you download and use our Products, we automatically collect information on the type of device you use, operating system version, and the device identifier (or ”UDID“). We may send you push notifications from time-to-time in order to update you about any events or promotions that we may be running. If you no longer wish to receive these types of communications, you can turn them off at the device level. To ensure you receive proper notifications, we will need to collect certain information about your device such as operating system and user identification information.

Geolocation

We collect information about where you are located when you are using our Products. We use this information for purposes such as optimizing your connection to our data center and suggesting customizations to your experience with our Products (e.g. your language preference). We share this information with parties such as our data center provider and our advertising partners. When Hyperfair Discloses Information

We may provide personally identifiable information and non-personally-identifiable information to businesses or persons for the purpose of processing such information on our behalf. In those instances, we will require that these parties agree to process such information in compliance with our privacy policy, and we use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures. We do not share your personally identifiable information (such as name or email address) with other, third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. We do share non-personally-identifiable information (such as anonymous User usage data, referring / exit pages and URLs, platform types, number of clicks, etc.) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the Hyperfair Site. We may release personally identifiable information and/or non-personally-identifiable information if required to do so by law, or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. Copyright Law) or respond to a court order, subpoena, or search warrant. Please note that media files uploaded by Users to the Hyperfair Site cannot be removed and remain subject to our Terms of Use. Third-party Advertisers, Links to Other Sites

Hyperfair allows other companies, called third-party ad servers or ad networks, to serve advertisements within the Hyperfair Site. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on the Hyperfair Site. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or Web Beacons) to measure the effectiveness of their advertisements and to personalize the advertising content you see. Hyperfair does not provide any personally identifiable information to these third-party ad servers or ad networks without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. Our Commitment To Children Privacy

Protecting the privacy of young children is especially important. For that reason, Hyperfair does not knowingly collect or maintain personally identifiable information or non-personally-identifiable information on the Hyperfair Site from persons under 13 years of age, and no part of our website is directed to persons under 13. If you are under 13 years of age, then please do not use or access the Hyperfair Site at any time or in any manner. If Hyperfair learns that personally identifiable information of persons under 13 years of age has been collected on the Hyperfair Site without verified parental consent, then Hyperfair will take the appropriate steps to delete this information.

The Hyperfair Site is hosted in the cloud.
